By accessing or using the Elevate Listings platform, website, and related services (collectively, the "Services") operated by CLIK Technologies Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Agreement"). If you do not agree to all of the terms and conditions of this Agreement, you may not access or use the Services.
This Agreement constitutes a legally binding contract between you and the Company regarding your use of the Services. Please read it carefully.
To access certain features of the Services, you must register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other breach of security. The Company will not be liable for any loss or damage arising from your failure to comply with this section.
Elevate Listings provides an AI-powered real estate marketing platform that includes, but is not limited to:
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information and is hereby incorporated into this Agreement by reference.
The Company reserves the right to modify this Agreement at any time. We will make reasonable efforts to notify you of material changes via email or by posting a notice on the website. Material changes will become effective 30 days after notification. Your continued use of the Services after such changes constitutes your acceptance of the revised Agreement.
You retain ownership of all content you submit to the platform, including listing photos, property descriptions, and other materials ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, transferable, fully paid-up, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Services.
You represent and warrant that you have the right to submit all User Content and that such content does not infringe upon the intellectual property rights or other rights of any third party.
Certain features of the Services utilize artificial intelligence and automated software to generate marketing assets including video tours, landing pages, ad creative, and digital brochures. These AI-generated outputs are provided as-is and may require review before publication. The Company does not guarantee the accuracy of AI-generated content. You are responsible for reviewing and approving all generated content before it is published or distributed.
The Company offers a free marketing asset generation tool (the "Free Tool") that allows users to submit a property listing address or URL and automatically generate marketing assets including interactive digital brochures, lead capture landing pages, and thank-you pages. Where you submit an address, you authorize the Company to identify and locate the corresponding public property listing on your behalf.
By submitting a property listing address or URL to the Free Tool, you expressly authorize and consent to the Company — acting directly or through third-party data providers and automated retrieval services engaged on its behalf — locating, accessing, retrieving, and extracting data, content, images, descriptions, and other materials from the online listing for that property, wherever it is published (collectively, "Listing Data"). You grant the Company a worldwide, non-exclusive license to:

All marketing assets generated by the Free Tool using your Listing Data remain your property. The Company retains ownership of the underlying AI models, software, and platform technology. You may use generated assets for marketing and promotional purposes related to the property listing.
The Company does not guarantee that it will locate the correct listing for the address you submit, or that it will accurately or completely extract all Listing Data from it. Formatting, availability of images, or technical issues with the source listing may impact the quality and completeness of generated assets. You are responsible for reviewing and verifying all generated content, including that it corresponds to the correct property, before publication.
If your property listing is published on a third-party platform (e.g., MLS, Zillow, Realtor.com, Kijiji, etc.), you acknowledge and agree that the Company, or a third-party data provider acting on its behalf, may retrieve Listing Data from that platform in order to provide the Free Tool, and that it does so in reliance on the authorization and representations you give in Sections 8.1 and 8.2. You acknowledge that such platforms' terms of service may restrict data extraction. You agree to comply with any applicable terms of service from the third-party platform and assume all liability for any violations. The Company is not responsible for any disputes arising from your use of third-party listing data.
You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from and against any claim, demand, loss, or expense (including reasonable legal fees) arising out of or related to the retrieval or use of Listing Data for a property you submit, where such claim arises from a breach of your representations in Section 8.2 or from your failure to comply with a third-party platform's terms of service.
The Company will use Listing Data solely to generate marketing assets for the property and to improve the Free Tool. Listing Data will not be sold or rented. It may be shared with third-party service providers, including data retrieval and search providers, solely to the extent necessary to locate the listing, retrieve Listing Data, and generate your marketing assets. Please refer to our Privacy Policy for additional information on data handling.

Access to certain features of the Services requires a paid subscription. Subscription terms, pricing, and billing cycles will be presented to you at the time of purchase.
Where agreed upon as part of your subscription, the Company may offer geographic exclusivity for lead generation campaigns. Leads generated through your campaigns are exclusively yours and will not be sold or distributed to other agents. The specific terms of exclusivity, including geographic boundaries, will be defined in your subscription agreement.
Either party may terminate this Agreement at any time. You may cancel your subscription by contacting your account manager or through the platform settings. The Company reserves the right to suspend or terminate your account without prior notice if you breach any provision of this Agreement. Upon termination, your right to use the Services ceases immediately.
All content, features, and functionality of the platform — including but not limited to text, graphics, logos, software, AI models, and design — are the exclusive property of CLIK Technologies Inc. and are protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Services without prior written consent.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC NUMBER OF LEADS WILL BE GENERATED (UNLESS EXPLICITLY GUARANTEED IN YOUR SUBSCRIPTION AGREEMENT).
IN NO EVENT WILL CLIK TECHNOLOGIES INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE LESSER OF THE AMOUNT PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS ($100 CAD).
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any disputes.
